Section 3 Caring for the bereaved of soldiers

Section 41 Pay for the month of death and death grants for surviving dependents of soldiers on a temporary basis and of soldiers who do military service according to the Military Service Act, voluntary military service or military service according to Section Four of the Soldiers Act

Section 42 Ongoing support for the surviving dependents of soldiers on a temporary basis and of soldiers who do military service according to the Military Service Act, voluntary military service or military service according to the fourth section of the Soldiers Act



(1) 1If a soldier who has served at least six years of military service in the Bundeswehr dies during the duration of his employment relationship and the death is not the result of damage to military service, the surviving spouse and dependent children can request ongoing support for the Get time of their need. The amount and duration of the support may not exceed the transitional fees that the deceased soldier could have received on the basis of the military service he had served at the time of death.

(5) In addition to a supply according to this paragraph, no supply according to § 43 is granted.

(6) For the purposes of Section 4, the widow and orphans are considered widows and orphans of a soldier or a retired soldier.




Section 43 Survivors of professional soldiers




(2) 1The widow, the divorced spouse and the children of a deceased professional soldier to whom a maintenance contribution has been or could have been granted pursuant to Section 36 can, upon application, receive the provision provided for in Sections 19, 20 and 22bis25 of the Civil Service Pension Act up to of the amount specified there as a maintenance contribution. This also applies to the former spouse of a deceased professional soldier or retired soldier whose marriage to him or her was annulled or declared null and void. 3Sections 21, 27 and 86 of the Civil Service Providers Act apply accordingly.

(3) 1Orphan's allowance is not granted if the mother's husband was missing during the legal conception period. 2This does not apply if the missing person has returned, unless his paternity has been contested later.





Section 44 Payments in the event of missing



(1) A lost professional soldier, temporary soldier, retired soldier or other beneficiary receives the service or pension payments due to him until the end of the month in which the Federal Ministry of Defense determines that his death is likely to be assumed.

(2) 1From the first of the month following the point in time specified in Paragraph 1, those persons who, in the event of the death of the missing person pursuant to Section 11 Paragraph 6 Clause 4 or Clause 5 or Section 11a Paragraph 2, receive transitional fees according to Section 12 para. 7 would receive a transitional allowance, a support according to Section 42, widow's or orphan's allowance or a maintenance contribution according to Section 43, these payments. 2If a soldier has gone missing for a certain period of time during a special assignment abroad pursuant to Section 63c Paragraph 1, persons who would receive widow's or orphan's allowance or a maintenance contribution in the event of the death of the missing person pursuant to Section 42a receive these benefits instead of the benefits pursuant to Clause 1; Benefits according to sentence 1 to other people are not paid in addition. 3The remuneration for the month of death and the death benefit are not granted.

(3) 1If the missing person returns, his or her entitlement to remuneration or pensions is revived, unless there are special legal reasons to the contrary. 2Supplementary payments for service or pension remuneration are to be made for a maximum of one year; the remuneration granted in accordance with paragraph 2, in accordance with Section 80 and in accordance with other laws due to the missing person for the same period of time shall be taken into account.

(4) If it turns out that a soldier fulfills the requirements of Section 9 of the Federal Salary Act, the remuneration paid in accordance with paragraph 2 can be reclaimed from him.

(5) If the missing person is declared dead or the time of death is judicially determined or a death certificate is issued for the death of the missing person, the survivor's pension is from the first of the month following the legal force of the court decision or the issue of the death certificate, taking into account the determined To fix the time of death anew.





Section 44a survivors of soldiers, surviving life partners



1In the case of surviving dependents of women, the widow's allowance takes the place of the widow's allowance and the widow's widow takes the place of the widow. 2This does not apply to surviving life partners. 3In the case of a surviving partner, the widow's benefit is replaced by the widower's benefit.
