Because theft is always a crime; the legal basis for this is formulated in Section 242 of the Criminal Code. According to this, a person commits a theft when he steals or takes away another person's movable property. A criminal act of this kind is punished by the legislature with a fine or even with a prison sentence of up to five years. It is important here that even the attempt is punishable by law.
This penalty also applies in the case of proven electricity theft, although the subjective offense must always contain both intent and deed. This premise is explicitly written down in Section 15 of the Criminal Code. The corresponding legal basis for the application of the penalty can be found in Section 248c of the Criminal Code; this section was incorporated into the Criminal Code in October 1953. It does not matter whether this ultimately resulted in damage. Because this circumstance is not necessary for the fulfillment of the relevant facts.

You only need a little patience here to uncover the brazen electricity theft according to StGB § 248c and to identify the culprit.
Electricity theft: landlords, utilities and police
If you have a well-founded suspicion or can directly prove an electricity theft, you should report this electricity theft immediately. On the one hand, you have to inform your landlord and the electricity supplier as quickly as possible. On the other hand, you can, of course, report an electricity theft to the police yourself or report it directly to the police. The electricity supplier itself can only become directly active if the electricity meter has been manipulated directly. The situation is different if the power thief has tampered with the house lines, which legally belong to the landlord. Because here the landlord is obliged to take legal action against the power thief. And not only that. If the electricity theft is due to work errors, for example in the context of renovations, the landlord has to correct it as soon as possible according to current case law.
Use adhesion methods in the event of electricity theft
The amount of damage caused should then always be assessed together in order to be able to provide an appropriate compensation. Whether you as the injured party will get your damage reimbursed is not certain from the outset, even if the perpetrator has received a punishment for electricity theft from the legislature. However, you always have the option of enforcing your rights through civil law. But you have one more option. Because the so-called adhesion process can also be of decisive help here. In this procedure, which is anchored in the Code of Criminal Procedure (StPO), you as the injured party can also assert the claim for damages resulting from the theft of electricity directly in criminal proceedings.
You must apply for this adhesion procedure yourself and present the reason for the claim plus the evidence in writing. This application is treated by the legislature like a lawsuit in civil litigation. If you can justify your claim for damages or your claim for damages, the criminal court will grant it in the context of the pronouncement of the verdict or the electricity theft penalty; this decision is equivalent to a judgment from a civil process or a civil litigation.
